TERMS AND CONDITIONS OF USE AND ONLINE SALE

1. General provisions and legal framework
1.1. These Terms and Conditions establish the general legal framework applicable to e-commerce operations, browsing on the www.nismobil.md online platform and placing orders through the checkout form between NISMOBIL GRUP S.R.L. (as Seller) and its customers (as Buyers).
1.2. The legal relations between the parties shall be governed in accordance with the law of the Republic of Moldova, in particular:
● The Civil Code of the Republic of Moldova (provisions on public offering, art. 1029, and the distance sale-purchase contract);
● Law no. 284/2004 on information society services;
● Law no. 105/2003 on consumer protection;
● Law no. 114/2012 on payment services and electronic money;
● The legal framework on the protection of personal data (Law no. 133/2011 and Law no. 195/2024).
1.3. By ticking the box “I have read and agree to the terms and conditions of the website” and by clicking on the button “PLACE ORDER”, the Buyer expresses his express, free and unvitiated consent to the full application of these contractual clauses.
1.4. The products displayed on the site are valid within the limit of available stock. The prices displayed are expressed in Moldovan lei (MDL) and include VAT, subject to the rectification of obvious printing or technical errors.
2. Definitions and notions
● Seller / Operator: NISMOBIL GRUP S.R.L., legal entity registered according to the legislation of the Republic of Moldova, having its headquarters in MD-6434, s. Seliște, rl. Nisporeni, Republic of Moldova, IDNO: 1005609000726.
● Buyer / Customer: any natural person (consumer) or legal entity who accesses the www.nismobil.md platform and places an electronic order.
● Consumer: any natural person who acts for purposes outside his commercial, industrial, production or professional activity, benefiting from the protection of Law no. 105/2003.
● Website / Online Store: the online store accessible at the www.nismobil.md web address, managed by the Seller.
● Products: the pieces of furniture, accessories and goods displayed for sale on the www.nismobil.md.
● Order: the electronic document generated by filling in the checkout form on the website, through which the Buyer requests the desired products and provides identification, billing and delivery data.
● Distance contract: the agreement between the Seller and the Buyer, considered concluded at the time of electronic or telephone confirmation of the Order by the Seller.
3. Procedure for placing the order and concluding the contract
3.1. The buyer selects the desired products, chooses the available configurations/features and adds the goods to the shopping cart.
3.2. On the checkout page, the Buyer fills in the mandatory data necessary for processing, invoicing and delivery:
● Identification and contact data: First Name, Last Name, Phone Number, Email Address;
● Billing and delivery data: Country/Region (Republic of Moldova), Street (full address), Municipality/District, City, Zip Code;
● Account Option: Log in to an existing account or check the optional option to create a user account on the website.
3.3. The transmission of the order by clicking the “PLACE ORDER” button constitutes a firm purchase offer. The contract is considered valid when the Seller confirms the order by e-mail or telephone.
3.4. The seller reserves the right to cancel the order in justified situations: unavailability of stock, failed/unauthorized online transaction, incomplete or erroneous data provided by the customer or obvious technical errors in the display on the website.
4. Payment methods
For the payment of online orders we provide you with the following payment conditions:
● Online with a bank card (Visa, Maestro and Master Card).
● Cash on delivery, by courier (Nova Poshta).
● Cash or card when picking up products from the store.
5. Delivery conditions and deadlines
Any product can be purchased online by placing the order in the shopping cart. Our partner, Nova Poshta, delivers the products directly to your door (up to the staircase or gate). We offer both the home delivery service and the possibility of pick-up in person from the store. For pick-up from the store, it is necessary to indicate the pick-up day in the order confirmation section.
Terms and Conditions:
● Delivery to the territory of the Republic of Moldova (except Transnistria) is made on working days, from Monday to Friday, between 09:00 – 17:00.
● In Chisinau: 45 lei for orders up to 2 kg and 360 lei for orders over 50 kg.
● Delivery on the territory of the Republic of Moldova is made within 3-4 days.
● Cost of delivery in the regions: 65 lei for parcels up to 2 kg and 360 lei for parcels over 20 kg.
Please provide all details of the delivery address. If the delivery address differs from the one in your account, please specify this when placing your order.
6. Right of withdrawal, return and guarantee
Return conditions:
The products can be returned to the warehouse address: 21 Pădurii Street, Chisinau, if they comply with the following:
● They do not exceed the term of 14 days from the date of purchase.
● No signs of damage or wear.
● They are returned in the original packaging, with all accessories, labels intact and the receipt.
It is possible to exchange the size or with another item. The conditions are in accordance with Law no. 105 of 13.03.2003 on consumer protection. All expenses related to the organization of the return are fully borne by the customer.
Refund of amounts:
● Cash: for amounts paid in cash in the store.
● By bank transfer: for payments made by bank (O.P.), including by bank card.

8. Protection of personal data and cookies
8.1. NISMOBIL GRUP S.R.L. processes the personal data collected through the checkout form in strict compliance with the applicable legislation (Law no. 133/2011 and Law no. 195/2024).
8.2. Full details regarding the rights of data subjects, the grounds for processing and the use of cookies are set out in the separate document “Privacy Policy“, permanently published on the www.nismobil.md platform.
9. Disputes and final provisions
9.1. Any disputes between NISMOBIL GRUP S.R.L. and the Buyer shall be settled amicably. If an amicable settlement is not possible, the jurisdiction lies with the competent courts of the Republic of Moldova.
9.2. The Seller reserves the right to periodically update these Terms and Conditions, the version applicable to the contract being the one in force at the time the order is placed by the Buyer.
