TERMS AND CONDITIONS OF USE AND ONLINE SALE

1. General provisions and legal framework
1.1. These Terms and Conditions establish the general legal framework applicable to e-commerce operations, browsing the online platform www.nismobil.md and placing orders through the checkout form between NISMOBIL GRUP S.R.L. (as Seller) and its customers (as Buyers).
1.2. The legal relations between the parties are regulated in accordance with the legislation of the Republic of Moldova, in particular:
● The Civil Code of the Republic of Moldova (provisions on the public offer, art. 1029, and the distance sale-purchase contract);
● Law no. 284/2004 on information society services;
● Law no. 105/2003 on consumer protection;
● Law no. 114/2012 regarding payment services and electronic money;
● The legal framework regarding the protection of personal data (Law no. 133/2011 and Law no. 195/2024).
1.3. By checking the box “I have read and agree to the terms and conditions of the website” and by pressing the button “PLACE ORDER“, the Buyer expresses their express, free and unvitiated consent regarding the full application of these contractual clauses.
1.4. The products displayed on the site are valid within the limit of available stock. The displayed prices are expressed in Moldovan lei (MDL) and include VAT, being subject to the correction of obvious typing or technical errors.
2. Definitions and concepts
● Seller / Operator: NISMOBIL GRUP S.R.L., a legal entity registered according to the legislation of the Republic of Moldova, having its headquarters in MD-6434, Seliște village, Nisporeni district, Republic of Moldova, IDNO: 1005609000726.
● Buyer / Client: any natural person (consumer) or legal entity that accesses the platform www.nismobil.md and places an electronic order.
● Consumer: any natural person acting for purposes outside their commercial, industrial, production or professional activity, benefiting from the protection of Law no. 105/2003.
● Site / Online Store: the online store accessible at the web address www.nismobil.md, managed by the Seller.
● Products: furniture pieces, accessories and goods displayed for sale on www.nismobil.md.
● Order: the electronic document generated by filling out the checkout form on the site, through which the Buyer requests the desired products and provides identification, billing and delivery data.
● Distance contract: the agreement reached between the Seller and the Buyer, considered concluded at the moment of electronic or telephone confirmation of the Order by the Seller.
3. Order placement procedure and conclusion of the contract
3.1. The Buyer selects the desired products, chooses the available configurations/characteristics and adds the goods to the shopping cart.
3.2. On the order finalization page (checkout), the Buyer fills in the mandatory data necessary for processing, billing and delivery:
● Identification and contact data: First Name, Last Name, Phone Number, E-mail address;
● Billing and delivery data: Country/Region (Republic of Moldova), Street (full address), Municipality/District, Locality, Postal code;
● Account option: authenticating into an existing account or checking the optional option to create a user account on the site.
3.3. Transmitting the order by pressing the “PLACE ORDER” button constitutes a firm purchase offer. The contract is considered validly concluded when the Seller confirms the order by e-mail or by phone.
3.4. The Seller reserves the right to cancel the order in justified situations: stock unavailability, failed/unauthorized online transaction, incomplete or erroneous data provided by the client or obvious technical display errors on the site.
4. Payment methods
To pay for online orders, we provide you with the following payment conditions:
● Online with bank card (Visa, Maestro and Master Card).
● Cash on delivery, by courier (Nova Poshta).
● Cash or card when picking up products from the store.
5. Delivery conditions and terms
Any product can be purchased online by placing the order in the shopping cart. Our partner, Nova Poshta, delivers products directly to your door (up to the stairs or gate). We offer both home delivery service and the possibility of personal pickup from the store. For store pickup, it is necessary to indicate the collection day in the order confirmation section.
Terms and conditions:
● Delivery on the territory of the Republic of Moldova (with the exception of Transnistria) is carried out on working days, from Monday to Friday, between 09:00 – 17:00.
● In Chișinău: 45 lei for orders up to 2 kg and 160 lei for orders over 50 kg.
● Delivery on the territory of the Republic of Moldova is carried out within 3 days.
● Cost of delivery in regions: 65 lei for parcels up to 2 kg and 260 lei for parcels over 20 kg.
Please indicate all data regarding the delivery address. If the delivery address differs from the one in the account, specify this at the time of placing the order.
6. Right of withdrawal, return and warranty
Return conditions:
Products can be returned to the warehouse address: 21 Pădurii street, Chișinău, if they respect the following:
● They do not exceed the term of 14 days from the date of purchase.
● They show no signs of damage or wear.
● They are returned in the original packaging, with all accessories, intact labels and the tax receipt.
The option to exchange the size or with another item is possible. The conditions are in accordance with Law no. 105 of 13.03.2003 on consumer protection. All expenses related to the organization of the return are fully borne by the client.
Refund of amounts:
● In cash: for amounts paid in cash in the store.
● By bank transfer: for payments made through the bank (P.O.), including by bank card.

8. Protection of personal data and cookies
8.1. NISMOBIL GRUP S.R.L. processes the personal data collected through the checkout form with strict compliance with the applicable legislation (Law no. 133/2011 and Law no. 195/2024).
8.2. Full details regarding the rights of data subjects, the grounds for processing and the use of cookies are set out in the distinct document “Privacy Policy”, permanently published on the platform www.nismobil.md.
9. Disputes and final provisions
9.1. Any disputes between NISMOBIL GRUP S.R.L. and the Buyer will be resolved amicably. If an amicable settlement is not possible, the competence belongs to the competent courts of the Republic of Moldova.
9.2. The Seller reserves the right to periodically update these Terms and Conditions, the version applicable to the contract being the one in force at the time the order is placed by the Buyer.
